LONG TITLE
General Description:
This bill addresses major sources of halogen emissions.

Be it enacted by the Legislature of the state of Utah:
Section 1, Section 
19-2a-107
 is amended to read:
19-2a-107
. Point source pollution of halogens -- Control technology plan -- 
Annual report.
(1)
As used in this section:
(a)
"Applicable geographic area" means the following counties:
(i)
Box Elder County;
(ii)
Davis County;
(iii)
Salt Lake County;
(iv)
Tooele County;
(v)
Utah County; and
(vi)
Weber County.
(b)
(a)
"Division" means the Division of Air Quality created in Section 
19-1-105
.
(b)
"Major halogen source" means a facility, building, structure, or installation that has 
the potential to emit 3,000 tons or more of a halogen per year from the smelting, 
mining, or extracting of magnesium.
(2)
(a)
The division may complete a best available control technology emissions 
reduction plan to reduce halogen emissions for all major halogen sources.
(b)
The division may require an operating major halogen source to implement a plan 
described in Subsection 
(2)(a)
 with an implementation date determined by the 
division.
(c)
The division may create a plan described in Subsection 
(2)(a)
 based on the division's 
status report for halogen reductions and standards recommendations submitted to the 
Natural Resources, Agriculture, and Environment Interim Committee in October 
2024.
(3)
The division may modify the plan described in Subsection 
(2)
 to include a more 
cost-effective control technology if the cost-effective control technology achieves the 
same or better reduction in halogen emissions as the best available control technology.
(4)
(a)
The division shall submit a halogen emissions report to the Natural Resources, 
Agriculture, and Environment Interim Committee on or before October 31 of each 
year.
(b)
The report described in Subsection (4)(a) shall include:
(i)
the status of halogen emissions in this state;
(ii)
the effectiveness of the controls described in Subsection (2); and
(iii)
recommendations, if any, from the division for legislative action to address 
halogen emissions.
(2)
By no later than December 31, 2024, the division shall complete:
(a)
an air emissions inventory of point sources in the applicable geographic area that 
emit halogens;
(b)
a best available control technology emissions reduction plan to reduce the 
compounds of halogens in the applicable geographic area, with an implementation 
date of December 31, 2026; and
(c)
recommendations for a state standard limiting halogen emissions.
(3)
Upon completion, the division shall publish the air emissions inventory, the best 
available control technology emissions reduction plan, and the recommendations on 
standards required under Subsection 
(2)
 on the division's public website.
(4)
The division shall report to the Natural Resources, Agriculture, and Environment 
Interim Committee regarding the status of the air emissions inventory, the best available 
control technology emissions reduction plan, and the recommendations for a standard:
(a)
on or before the 2023 November interim committee meeting of the Natural 
Resources, Agriculture, and Environment Interim Committee; and
(b)
on or before the 2024 November interim committee meeting of the Natural 
Resources, Agriculture, and Environment Interim Committee.
Section 2. 
Effective Date.
This bill takes effect on 
May 7, 2025
