LONG TITLE
General Description:
This bill provides that a local education agency is not required to enforce a requirement
in a public health order for individuals to wear a face mask on school grounds.

Be it enacted by the Legislature of the state of Utah:
Section 1. Section 
53G-9-210
 is enacted to read:
 53G-9-210.
Mask requirement during COVID-19 emergency.
(1) As used in this section:
(a) "COVID-19 emergency" means the same as that term is defined in 
53G-6-502
.
(b) "Face mask" means the same as that term is defined in a public health order that
requires individuals to wear a face mask on school grounds.
(c) "Public health emergency" means the same as that term is defined in Section
53-2c-102
.
(d) "Public health order" means an order issued in response to a public health
emergency that is:
(i) an executive order that the governor issues:
(A) declaring a state of emergency under Section 
53-2a-206
; or
(B) under a state of emergency declared under Section 
53-2a-206
;
(ii) an order that the Department of Health issues; or
(iii) an order that a local health department issues.
(2) Notwithstanding anything to the contrary in Utah law, an LEA is not required to
enforce a requirement in a public health order issued in response to the COVID-19 emergency
for individuals to wear a face mask on school grounds.
